After a long struggle the violated labor right of the worker was restored

On June 11, 2018 a citizen Lyudmila Avagyan, who worked from January 1, 2005 to July 1, 2017, as a cleaner at Derjava-C CJSC, applied to the Confederation of Trade Unions of Armenia in order to clarify her rights to get payments for all holidays during the period of work before  terminating her employment contract. According to L. Avagyan, during the entire period of work as a cleaner at a gas station, she never received a vacation permit. The employer explained his refusal to grant leave by the fact that there was no one to replace her. After  she quitted her job, L. Avagyan accidentally heard an interview on the radio with the lawyer of the Confederation of Trade Unions of Armenia M. Piliposyan, who spoke about a similar case of non-payment of money for unused vacation and legal assistance provided. L. Avagyan decided to apply to the CPA, despite the fact that many considered it senseless and dissuaded her from this step. But the long legal proceedings ended in her victory, and she received compensation from Derjava-C CJSC in the amount of more than 1 million drams.
  It should be noted that Derjava-C CJSC does not have a trade union organization and is not a member of any branch republican union of the Confederation of Trade Unions of Armenia.
Below is the verdict of the court.
   Partially cancel the decision of the court of general jurisdiction of the city of Yerevan in civil case No. ED / 24558/02/18 dated 11/18/2021 and state the following in the final part of the decision:
   "1. Satisfy the claim of Lyudmila Avagyan against Derjava-C CJSC for unpaid compensation and recovery of damages for unused vacation.
   2. Collect AMD 633,180 (six hundred thirty-three thousand one hundred and eighty) AMD 633,180 (six hundred thirty-three thousand one hundred and eighty) from Derjava-C CJSC in favor of Lyudmila Avagyan as monetary compensation for unused vacation.
   3. In accordance with Article 198 of the Labor Code of the Republic of Armenia, withhold from CJSC "Derjava-C" in favor of Lyudmila Avagyan a fine for each overdue day in the amount of 0.15% of the amount of 633,180 (six hundred thirty-three thousand one hundred and eighty) AMD for the period from 07/01/2017 until the day of actual payment of the established amount, but not more than 633,180 (six hundred thirty-three thousand one hundred and eighty) AMD.
  Lyudmila Avagyan expressed her deep gratitude to the Confederation of Trade Unions of Armenia for consistent legal assistance in protecting her labor rights.
